The parties referred to this Agreement are defined as follows:

For online accessibility and digital marketing, the Company has created and published this website available to Users. Unless otherwise stated, “Talent Lifting”, “Company”, “We”, “Us”, “Our”, “Ours” and all other first-person pronouns used on this website collectively refers to  Talent Lifting Training and Offshore Consultancy and its employees.

You as the user of this website will be referred to as “You”, “Client”, “Your”, “Yours”, “User” and all other second-person pronouns.

The parties to this Agreement, the Company and You, are collectively referred to as “Parties”.

2. Acceptance:

3. License to use and Intellectual property:

The Company provides this licence, which is non-exclusive, non-transferable and revocable, to the User for the sole purpose of viewing the website only and does not constitute any right to the User to print, edit, publish and tag. This licence terminates upon the cessation of the Users session/ activity in the website.

The User agrees that all copyrights and intellectual property rights of the above mentioned are either owned by Talent Lifting or its respective owners and shall not use these for any unlawful or infringing purpose. 4. Limitation of our Liability and Indemnification: 

You agree that through the use of this website, the Company will not be held responsible and liable for any of the below listed;

4.1 Any direct, indirect and consequential loss or damage including data, profit, revenue, sales, etc. Also includes any cyber-attack or related on the User systems and its subsequent aftereffects.

You agree to defend and indemnify the Company and hold the Company harmless against all legal claims and demands, including attorney's fees, which may arise from or relate to Your use/ misuse of Our website, Your breach of this Agreement or Your conduct/ actions. You agree that the Company may also select its own legal counsel and participate in its own defense, if the Company wishes to.

5. Modification of Terms & Conditions: 

You agree that the Company reserves all the rights to modify this Agreement partially or fully, without notice to You. 

You agree that the laws of the State of Kerala and the Democratic Republic of India shall govern any dispute relating to or arising out of this Agreement. In case of any litigation specifically permitted under this Agreement is initiated, the Parties agree to submit to the personal jurisdiction of the State of Kerala. The Parties agree that this choice of law, venue and jurisdiction provision is not permissive in nature, but rather mandatory. You hereby agree to waive off objection to any of these.

In case of any dispute(s) between the Parties relating to or arising out of this Agreement, the Parties shall first attempt to resolve the dispute personally and in good faith. If these personal resolution attempt fails, the Party(s) shall submit the dispute to the binding arbitration.

If any part or sub-part of this Agreement is held invalid or unenforceable by court of law or a competent arbitrator, then the remaining parts and sub-parts of this Agreement will be enforced to maximum extent possible, in such a situation the remainder of this Agreement shall continue in full force.

All communications made or notices issued pursuant to this Agreement shall be either in Malayalam or English language.
